探析盗赃物善意取得制度



摘要





随着市场经济的不断完善和交易活动愈加频繁，实践中出现的当善意第三人取得盗赃物之后物的所有权归属该如何打算的问题，我国法律并未说明。关于盗赃物的善意取得法律制度引发广大学者们纷纷热议。在我国《物权法》第107条中，立法者只制定了关于遗失物而无盗赃物的善意取得制度。盗赃物应当怎样纳入善意取得制度中，学界众说纷坛，各国相关立法也不尽相同。法律在此处的空缺对实际市场交易不能起到很好的保护作用。且我国立法者对于盗赃物的善意取得制度采取回避的态度已不再适应我国愈加频繁的商品交易与经济的稳定健康发展，此为法律上的漏洞。本篇文章将在《物权法》的基础上研究善意取得制度，通过探析赃物善意取得的相关制度，比较各国适用的不同法律，提出修改该法律制度的建议，弥补我国关于盗赃物善意取得制度的法律空缺，完善我国的善意取得制度。

ABSTRACT



With the continuous improvement of the market economy and trading activities more frequently, Our law does not state thatwho can own the object after the bona fide third party get the stolen goods In practice.About the acquisition in good faith of stolen goods has caused a heated discussion.

Article 107 of the Property Law of the People's Republic of China only stipulates the system of bona fide acquisition of the lost objects without stolen goods.How the stolen goods into the acquisition in good faith,Academics say altar and the relevant legislation is not the same.The law can not play a very good protective effect with this vacancy on the actual market transactions.And the attitude of the legislators has an evasive attitude has no longer adapted to China's increasingly frequent commodity trade and the stable and healthy development of the economy.This is a legal loophole.This article will study the acquisition in good faith on the basis of the Property Law.Through studying on the relevant system of the acquisition in good faith and compare the different laws applicable to each country.Proposing amendments to the legal system can make up for our country on the theft of stolen goods acquisition system of legal vacancies and finally improve the acquisition in good faith.
