第一条 为进一步规范我省煤矿改建、扩建项目及整合技改项目竣工验收管理工作，根据《中华人民共和国煤炭法》、《关于加强小煤矿安全基础管理的指导意见》（安监总煤调〔2007〕95号)、《关于加强煤矿安全生产工作规范煤炭资源整合的若干意见》（安监总煤矿〔2006〕48号）、《云南省人民政府关于印发云南省煤炭资源整合工作实施方案的通知》（云政发〔2007〕151号)及有关法律、法规和政策的规定,结合本省实际,制定本办法。

第二条 本办法适用于本省范围内煤矿改建、扩建项目的竣工验收工作。

第三条 煤矿改建、扩建项目竣工验收前，煤矿建设单位应当编制联合试运转方案及安全保障措施，方可进行联合试运转，并按照隶属关系及时向煤炭行业管理部门或者主管部门单位备案。

第四条 煤矿改建、扩建项目在进行联合试运转期间，应当制定切实可行的安全措施，做好现场检测、检验,收集有关数据。

煤炭行业管理部门或者主管部门单位应当指导煤矿建设单位对联合试运转过程中发现和存在问题进行整改,并对相关资料补充完善。

第五条 煤矿改建、扩建项目联合试运转结束后，建设单位应当编制联合试运转报告，向相关部门申请安全、环保等专项验收。专项验收完成后,建设单位应当编制项目竣工验收报告，并按隶属关系逐级上报项目竣工验收申请。

第六条 煤矿改建、扩建项目在建设过程中，矿井开拓方式、提升运输方式及通风类型、通风方式发生变化的；矿井瓦斯等级、煤层自燃类型、煤尘爆炸性危险等级以及矿井水文地质类型发生变化的；开采地质条件、采煤方法及工艺发生变化的；首采区及首采工作面布置发生较大变化的，应当修改初步设计并按规定程序报批。

第七条 煤矿建设单位应当逐级向煤炭行业管理部门提出竣工验收申请,据实填写《云南省煤矿建设项目竣工验收申请表》(一式三份)，并提交以下材料:

（一)建设项目竣工综合验收申请； （二）建设项目联合试运转报告；

（三）采矿许可证、安全生产许可证、煤炭生产许可证、工商营业执照、矿长资格证和矿长安全工作资格证复印件；

(四)项目核准文件，初步设计、安全专篇及其审批文件，开工备案等材料； （五)安全、环保等专项验收批复文件、工程质量认证报告书等相关材料； (六)矿井竣工实测图，主要包括： 1。采掘工程平面图； 2。矿井通风系统图； 3。安全监测监控系统布置图；

4。井下避灾路线图； 5。井上、下对照图；

6.井上下配电系统图和井下电气设备布置图； （七）法律、法规规定的其它材料.

第八条 煤矿改建、扩建项目竣工验收,按设计生产能力实行分级负责。竣工验收由煤炭行业管理部门负责组织实施，煤矿安全监管、煤矿安全监察、发展改革委、环保以及煤矿改建、扩建项目设计、施工等单位参加验收.

（一)设计生产能力在9万吨/年及其以下的煤矿改建、扩建项目竣工验收，由州(市）煤炭行业管理部门组织验收，报省工业和信息化委批复。

（二）设计生产能力在9万吨/年以上的煤矿改建、扩建项目竣工验收，由省工业和信息化委组织验收并批复。省工业和信息化委可根据实际情况,委托省煤炭行业技术审查专家委员会（以下简称省专家委员会）进行验收，形成项目竣工验收专家组意见。

（三)省监狱管理局、云南煤化工集团公司所属煤矿的改建、扩建项目竣工验收,按隶属关系逐级申

报，由省工业和信息化委组织验收。

第九条 煤矿改建、扩建项目竣工验收应当符合下列条件：

（一)改建、扩建及整合技改项目的建设规模、建设内容与批准的初步设计内容相符； （二）矿井安全设施、环保、工程质量认证等专项工程已建设完成并通过专项验收合格；

(三)煤矿建设项目主要生产系统全部形成,经联合试运转后，运转正常，工程质量符合国家有关规范、标准要求；

(四)首采工作面和首采区装备完成并具备生产条件，能保持正常生产接续;

（五）地面生产系统按设计建成，非工业性建筑满足生产生活需要，具备矿井生产的外部条件； (六）矿井组织机构设置符合生产、安全要求，规章制度建立健全，职工经过依法培训，特种作业人员取得上岗操作资格证书,矿长经培训合格并取得资格证书，图纸、技术资料等档案完整齐全并具备归档条件。

第十条 煤矿改建、扩建项目竣工验收工作，由省工业和信息化委从省专家委员会中抽选专家成立专家组,专家组成员人数不少于5人。竣工验收时应当听取煤矿建设单位有关情况汇报，查阅工程档案资料,现场检查验收矿建、土建、安装工程以及安全、环保等设施的质量、运转使用情况,并形成项目竣工验收专家组意见。

第十一条 省工业和信息化委在5个工作日内对项目核准申请材料完成审核，对不符合受理条件的煤矿改建、扩建项目，按规定程序一次性告知需要补充或者修改的内容。



第十二条 省、州（市）煤炭行业管理部门对符合受理条件的煤矿改建、扩建项目，应当在在30个工作日之内组织验收。
