政策性金融机构依法治理的社会学分析

【摘 要】The ultimate goal of the policy-based financial resource allocation is the social rationality. It is necessary to analyze the logical relationship between social interaction,deviant,law social control and the legislation of policy-based financial institutions from the perspective of sociology. The research shows that the negative interaction and the deviation among the policy-based financial institutions are the key factor to the positive development,and also the so-cial basis of the policy financial law system. To accelerate the legislation of policy-based finance is not only an effective means of social control to guide policy-based financial institutions operating orderly, but the prerequisite for gover-nance and the rule of law of supervision. On this basis, we put forward the basic suggestions of constructing the legal system of policy-based financial institutions and promoting the sustainable development of policy finance in China.%政策性金融资源配置的终极目标是社会合理性，有必要从社会学视阈分析社会互动、越轨、法律的社会控制作用与政策性金融机构立法之间的逻辑关系。政策性金融机构业务行为的负向互动及越轨既是阻碍其良性发展的关键因素，也是政策性金融法制生成的社会基础；加快政策性金融专门立法，不仅是规范和正向引导政策性金融机构有序运作的有效社会控制手段，而且是实现机构依法监管治理和法治化的前提条件。


在此基础上，本文提出构建政策性金融机构法制体系机制，促进我国政策性金融可持续发展的基本建议。 【总页数】5页(P35-39) 【作 者】王伟;王漫雪
