社会治理模式法治化--以“街头政治”为视角

【摘 要】街头政治的表现近年来在世界范围内风起云涌，乌克兰、泰国、土耳其、委内瑞拉、柬埔寨针对执政当局、执政者的游行示威活动风起云涌。我国的台湾地区2014年3月“反服贸”、4月“反核四”——两场声势浩大的“街头运动”搅动台湾社会，香港七一“占中环”，大陆内也出现了不同程度的街头政治现象，其负面影响极大。应该如何看待并规范街头政治行为，本文企图在公民权利和民主政治之间寻求合法的平衡点，使得街头政治行为纳入到社会治理法治化轨道，既实现了公民的民主政治权利，又不至于使街头政治背离民主政治的合法性而成为民主的暴政。%The “Street Politics” performance is surging around the world in recent years.Ukraine, Thailand, Turkey, Venezuela and Cambodia

The paper attempts to seek legal balance between civil rights and democratic politics so that the “Street Politics” can bring into the orbit of legalization of social governance, and can realize citizen’
